Terms of Service

  1. Services are provided "as is" and "as available." Conformal Group Inc. (hereinafter "Provider", "we", or "our") makes no representations or warranties, express or implied, regarding the operation, content, information, or services provided. To the fullest extent permitted by applicable law, Provider disclaims all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.

  2. By effecting a purchase, the Customer (hereinafter "the client", "you", or "your") acknowledges and agrees to the possibility of delays in the delivery of digital or online services. The Customer further affirms understanding and acceptance of the nature and substance of the services provided and confirms that all queries regarding the same have been addressed prior to the purchase.

  3. Provider shall not be liable for any damages whatsoever arising from the use of its services, including but not limited to, direct, indirect, incidental, punitive, and consequential damages. Provider's total liability to you, whether in contract, tort (including negligence), or otherwise, shall not exceed the amount you have paid for the services in question.

  4. Should any term, condition, or provision of these Terms be deemed invalid, void, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to render it enforceable, and the remaining provisions of these Terms will remain in full force and effect.

  5. All disputes related to the services provided by Provider shall be governed by and interpreted in accordance with the laws of the state of Delaware, without regard to its conflict of law rules.

  6. The Provider reserves the right to modify, suspend, or discontinue the services (or any part or content thereof) at any time without prior notice to you, and the Provider will not be liable to you or to any third party should it exercise such rights.

  7. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the service, use of the service, or access to the service without the express written permission by the Provider.

  8. The Customer agrees to defend, indemnify, and hold harmless the Provider, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the services, including, but not limited to, your User Content, any use of the service's content, services, and products other than as expressly authorized in these Terms.

  9. The Customer acknowledges that they have read and understood the Provider’s Privacy Policy, and agrees to the collection, use, and disclosure of their personal information in accordance with the said Privacy Policy. The Provider commits to compliance with the General Data Protection Regulation (GDPR) for services offered within the European Union.

  10. Unless the Customer notifies the Provider before the end of the subscription term that they want to cancel, their subscription will automatically renew and they authorize us (without further notice to them) to collect the applicable subscription fee and any taxes, using any credit card or other payment mechanism we have on record for them.

  11. The Customer hereby grants the Provider a non-exclusive, worldwide, royalty-free right to use, copy, store, transmit, and display their data to the extent necessary to protect the Customer and their data, perform research aimed at the improvement of the Provider's services, and develop new services. This includes analyzing usage patterns, trends, and performing other statistical analyses to improve our offerings and customer experience.

  12. Despite the above authorization, the Provider expressly commits not to sell, lease, share, or otherwise provide access to Customer data to any third party for the purposes of allowing them to market their products or services. The Provider shall not use Customer data for any purpose other than those explicitly outlined in these Terms without obtaining prior explicit consent from the Customer.

  13. The Provider may engage third-party service providers ("Sub-Processors") to assist in the processing of Customer data as part of the services provided. These Sub-Processors are only authorized to process Customer data in accordance with the Provider's instructions and under the terms of a written contract that ensures a level of security and confidentiality appropriate to the risks associated with the processing of such data. The Provider remains responsible for its Sub-Processors' compliance with the obligations of these Terms.

  14. The Provider respects the intellectual property rights of others and expects its users to do the same. The Provider will respond to clear notices of alleged copyright infringement in accordance with the DMCA.

  15. The Customer is solely responsible for the legality of the content they upload or share using the Provider's service. The Provider reserves the right to remove any content deemed illegal, infringing, or otherwise in violation of these terms without prior notice.

  16. The Provider's services are not intended for individuals under the age of 13. The Provider does not knowingly collect personal information from children under 13. If you are under 13, please do not submit any personal information through our services.

  17. These Terms and any action related thereto shall be governed by the laws of the state of Delaware without regard to its conflict of laws provisions. Any dispute arising from these Terms shall be submitted to the exclusive jurisdiction of the state and federal courts located in Delaware.
